1. Introduction

Welcome to Tyndall AI. By accessing or using our AI image generation service at tyndallai.com ("the Service"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully before using the Service.

2. Service Description

Tyndall AI provides AI-powered image generation, video generation, editing, and related creative tools. Some features may be available without signing in, while other features may require an account, subscription, credits, or payment. Tyndall AI is an independent product and interface layer built around in-house systems and third-party model providers; unless explicitly stated otherwise, Tyndall AI is not affiliated with or endorsed by the underlying model providers.

3. User Obligations

By using our Service, you agree to:

  • Use the Service in compliance with all applicable laws and regulations
  • Not attempt to circumvent any limitations or security measures
  • Not use the Service for any illegal or unauthorized purposes
  • Not interfere with or disrupt the Service or servers
  • Not generate content that violates intellectual property rights or contains harmful material

4. Intellectual Property Rights

Subject to these Terms and applicable law, paid subscribers may use content generated through the Service for personal or commercial purposes. Free users may use generated content for personal and other non-commercial purposes only, unless Tyndall AI expressly states otherwise. You are responsible for ensuring that your prompts, uploads, and resulting outputs do not infringe third-party rights, violate applicable law, or breach these Terms.

5. Privacy and Data Protection

Our privacy practices are described in our Privacy Policy. We follow a minimal data collection approach: requests from users who are not signed in are typically processed temporarily, while signed-in users may retain the information needed for account features, history, subscriptions, billing, support, and security protections.

6. Subscriptions, Billing, and Cancellation

If you purchase a subscription, credits, or other paid features, the applicable pricing, billing terms, and product entitlements will be presented at checkout or on the pricing page. Users can manage or cancel their subscription from the pricing page or through the subscription management portal made available by Tyndall AI. Cancellation generally stops future renewals but does not retroactively cancel benefits already provided for the current billing period, unless required by law.

7. Acceptable Use and Prohibited Content

You may use the Service only for lawful, non-abusive purposes. You may not use the Service to create, upload, request, generate, distribute, or attempt to generate content in any of the following prohibited categories:

  • Sexually explicit / NSFW content: any NSFW, sexually explicit, nude, semi-nude, sexually suggestive, pornographic, uncensored, or 18+ content
  • Violence / gore: content depicting graphic violence, gore, torture, or other extreme physical harm
  • Hate speech: content that promotes hatred, discrimination, harassment, or violence against individuals or groups based on protected characteristics such as race, ethnicity, national origin, religion, sex, gender, sexual orientation, disability, or similar attributes
  • Child safety (CSAM): any sexual, exploitative, abusive, or pornographic content involving minors (anyone under 18), including fictional, simulated, or AI-generated depictions; we have zero tolerance for child sexual abuse material
  • Deepfakes / impersonation: non-consensual deepfakes, face swaps, or other synthetic media intended to impersonate a real person, deceive others about someone's identity or actions, or enable fraud, defamation, or other harmful impersonation
  • Copyright / trademark infringement: content that infringes copyrights, trademarks, or other intellectual property rights of others

You also may not use the Service for any illegal purpose, to circumvent safety or security controls, or to generate content intended to harass, abuse, exploit, or otherwise harm others.

8. Enforcement Actions

If we determine that content, prompts, uploads, or account activity violates these Terms or our Acceptable Use rules, we may take one or more enforcement actions, including without limitation:

  • Blocking, filtering, refusing to process, or removing the relevant content or request
  • Issuing a warning to the account holder
  • Temporarily suspending or permanently terminating the account
  • Revoking credits, subscriptions, or other access privileges where appropriate
  • Preserving relevant records and reporting illegal activity to law enforcement or other authorities when required or appropriate

The severity of the enforcement action will depend on the nature, severity, and recurrence of the violation. Child safety violations and other illegal activity may result in immediate account termination and referral to authorities.

9. Reporting Violations

If you believe content generated through or hosted on the Service violates these Terms, infringes your rights, or otherwise poses a safety or legal risk, please report it to us at [email protected]. Please include relevant details such as URLs, screenshots, timestamps, account identifiers (if known), and a description of the concern so we can investigate promptly.

We generally acknowledge abuse and rights-related reports within 3 business days and aim to complete an initial review as quickly as reasonably practicable based on the severity and completeness of the report.

10. Content Moderation

We use a combination of automated systems and human review to detect, prevent, and respond to prohibited or abusive use of the Service. This may include prompt and output filtering, safety classifiers, rate limiting, abuse-signal monitoring, and manual review of flagged content or reports.

We may refuse, block, or remove content that appears to violate these Terms, and we may investigate suspicious activity even where no formal report has been submitted. Users remain responsible for their prompts, uploads, and how they use generated outputs.

11. Refunds and Support

As a general rule, purchases of digital and virtual products are non-refundable. If you have a refund request, billing issue, or other customer support need, please contact [email protected]. We review refund-related requests on a case-by-case basis and will generally respond within 3 business days. Nothing in these Terms limits any mandatory rights you may have under applicable law.

12. Service Availability

While we strive to maintain continuous service availability, we do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time without notice.

13. Limitation of Liability

The Service is provided "as is" without any warranties. We shall not be liable for any damages arising from the use of the Service, including but not limited to direct, indirect, incidental, punitive, and consequential damages.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after any changes constitutes acceptance of the new Terms. We will notify users of material changes by posting the updated Terms on this page.
